Aging Stronger reserves the right, and you authorize us, to use all information provided by or collected from you in any manner consistent with our Privacy Policy.

3. Consent to Other Agreements.

Due to medical or regulatory restrictions, certain products and services described on this Site may not be available to you.  EXCEPT AS EXPRESSLY STATED HEREIN, THE INFORMATION CONTAINED ON THIS SITE IS NOT AN OFFER TO SELL NOR A SOLICITATION OF ANY SERVICES OR OTHER PRODUCTS BY THE OWNER.

7. Purpose and Nature of Services.

We recommend treatments that we believe are likely (based upon our experience and training) to be effective, but we cannot guarantee results. You acknowledge that Leah Ashlee Therapy is unable to guarantee that its treatments will have any particular result.

8. Intellectual Property.

All content on this Site is the property of Aging Stronger, or is included with the permission of the rights owner(s), and is protected under applicable intellectual property laws. Any copying, redistribution, use or publication by you of any such content or any part of the Site is prohibited, except as expressly permitted in this Agreement. Under no circumstances will you acquire any ownership rights or other interest in any content by or through your use of this Site.

You are not authorized to copy, reproduce, use, or display our company name or logos without our written consent.

9. Site Use.

Aging Stronger grants you a limited, revocable, nonexclusive license to use this Site solely for your own personal use and not for download (other than page caching), modification, republication, distribution, assignment, sublicense, sale, preparation of derivative works, or other use, except with the express written consent of the Owner. You agree to access and use our Site for a noncommercial purpose, and not to copy content from the Site, reverse engineer or hack into the Site, or use materials in violation of any law. You agree that to the extent you provide personal information to us, it will be true, accurate, current, and complete, and that you will update personal information as necessary.

To the extent you create an account through this Site, you understand and agree that any account you create, including your username and password, are personal to you and may not be used by anyone else. You are responsible for maintaining the confidentiality of your username and password and are fully responsible for all activities that occur under your username and password by you or by anyone else using your username and password, whether or not authorized by you. You agree to comply with all applicable laws regarding your use of the Site. You further agree that information provided by you is truthful and accurate to the best of your knowledge.

12. Indemnity.

You agree to indemnify and hold Aging Stronger, LLC, and their respective members, officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of this Site in violation of these Terms and/or arising from a breach of these Terms and/or any breach of your representations and warranties set forth above and/or if any material that you post or upload using this Site causes us to be liable to another.

13. Disclaimer.

THE INFORMATION ON THIS SITE IS PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS. YOU AGREE THAT USE OF THIS SITE IS AT YOUR SOLE RISK. LEAH ASHLEE THERAPY DISCLAIMS ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO ANY EXPRESS WARRANTIES, STATUTORY WARRANTIES, AND ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO YOUR USE OF THE SITE SHALL BE TO DISCONTINUE USING THE SITE.

14. Limitation of Liability.

UNDER NO CIRCUMSTANCES WILL LEAH ASHLEE THERAPY, OR ITS MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS BE LIABLE OR RESPONSIBLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL (INCLUDING DAMAGES FROM LOSS OF BUSINESS, LOST PROFITS, LITIGATION, OR THE LIKE), SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN ANY WAY RELATING TO THE SITE, YOUR SITE USE, OR THE CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SITE AND/OR CONTENT IS TO CEASE ALL OF YOUR SITE USE.

YOU MAY HAVE ADDITIONAL RIGHTS UNDER CERTAIN LAWS (INCLUDING CONSUMER LAWS) WHICH DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF ANY PART OF THIS LIMITATION ON LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF THE RELEASED PARTIES FOR LIABILITIES THAT OTHERWISE WOULD HAVE BEEN LIMITED SHALL NOT EXCEED TEN DOLLARS ($10.00).

15. Copyrights and Copyright Agent.

Aging Stronger does not knowingly violate or permit others to violate the copyrights of others.  We will promptly remove or disable access to material that we know is infringing or if we become aware of circumstances from which infringing activity is apparent. If you believe your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have otherwise been violated, please provide a notice containing all of the following information to admin@agingstrongerki.com:

• An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;

• A description of the copyrighted work that you claim has been infringed;

• A description of where the material that you claim is infringing is located on the Site;

• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and

16. Applicable Law.

You agree that the laws of the state of Maryland without regard to conflicts of laws provisions will govern this Agreement and any dispute that may arise between you and Leah Ashlee Therapy or its affiliates. Venue shall be the state and federal courts located in the state of Maryland.

17. Severability.

If any provision of this Agreement shall be adjudged by any court of competent jurisdiction to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement will otherwise remain in full force and effect.

18. Relationship of the Parties.

Each party is, and shall remain, an independent contractor and nothing contained in this Agreement shall be construed to make either party a partner, joint venturer, employee or agent of the other party, and neither party shall hold itself out as such. Neither party has any right or authority to incur, assume or create, in writing or otherwise, any warranty, liability or other obligation of any kind, express or implied, in the name of or on behalf of the other party.
